These terms cover your use of jimenesconstruction.com (the "site"). The site is run by Jimenes Construction ("Jimenes Construction," "we," "us" or "our"), a general contractor based at 547 Connorvale Ln, Houston, TX 77060. By using the site, you agree to these terms. If you do not agree, please do not use the site.
The Short Version
- This website is information. It is not a contract. Your price, scope and schedule are set in a written contract that we both sign.
- Prices, budget ranges and timelines on this site are general. They are not quotes.
- Anything you upload to us stays yours. We only use it to look at your project.
- Texas law applies to these terms, and any dispute about them goes to courts in Harris County.
1. This Site Is Information
Everything on this site is general information about the work we do. Every build is different. Soil, drainage, plans, engineering, permits and local codes all change what a job needs and what it costs. Nothing on this site is engineering, legal or permitting advice for your property. For those, talk to a licensed engineer, an attorney or your local permit office.
Local rules change from city to city and county to county. We try to keep the site accurate, but rules and requirements change over time. Check with the permit office for your address before you rely on anything here.
2. Estimates, Proposals & Contracts
Filling out our form, calling us or asking for an estimate does not create a contract. It does not commit you or us to a project.
- Prices and timelines on the site are general. Budget ranges, typical schedules, drive times and similar figures are there to help you plan. They are not quotes and they can change.
- Proposals are free. We do not charge for an estimate or a written proposal. A proposal is good for the period stated on it.
- Work starts with a signed contract. A project only begins once we both sign a written contract. It sets the scope, price, schedule, payment terms and any warranty.
- The contract controls. If your written contract says something different from this site, the contract wins.
- Outside costs. Engineering, surveys, soil reports, permit fees and similar third-party costs are handled the way your contract says.
3. Texas Construction Notices
Texas law gives homeowners and contractors certain rights and duties on construction work. Your written contract will include the notices and disclosures Texas law requires for your type of project.
If you believe there is a construction defect in your home, the Texas Residential Construction Liability Act (Chapter 27 of the Texas Property Code) generally requires you to send the contractor a written notice describing the defect. The notice must go by certified mail, return receipt requested, at least 60 days before you file a lawsuit. The contractor then has a chance to inspect the work and make a written offer to fix it. Please send any such notice to the address in the Contact Us section.
Nothing in these terms takes away any right you have under Texas law.
4. Using the Site
You may use this site to learn about our services and to contact us. Please do not:
- send false information, or someone else's personal details without their permission
- upload files that contain viruses or other harmful code
- try to break into, overload or disrupt the site or the systems behind it
- copy contact details or other content from the site to send spam
- use the site for anything unlawful
5. Plans & Photos You Send Us
You can send us plans, drawings and site photos through our contact form or by email. Please only send files that you own or have the right to share. You keep all rights to them. By sending them, you let us use them to review, price and plan your project. We may also share them with the engineers, surveyors, suppliers and permit offices who need them for your job.
Please do not send payment card numbers, bank details or Social Security numbers through the site.
6. Calls & Text Messages
If you give us your phone number and ask us to call or text you, you agree that we may contact you at that number about your inquiry and your project. We will not send you marketing texts unless you agree to them separately.
- How often we text depends on your project.
- Message and data rates may apply.
- Reply STOP at any time to stop texts. Reply HELP for help, or call us at (832) 576-3278.
- You do not have to agree to texts to hire us.
Our Privacy Policy explains how we handle your phone number.
7. Our Content
The text, photos, logos, graphics and design of this site belong to Jimenes Construction or the people who licensed them to us. You may view and print pages for your own use. You may not copy, sell or republish our content, or use our name or logo, without our written permission.
Project photos and descriptions show the kind of work we do. Reviews and testimonials describe individual clients' experiences. Your project, cost and results may be different.
8. Google Maps & Other Sites
Some pages show maps provided by Google Maps. When you use those maps, the Google Maps Terms of Service and Google Privacy Policy apply. The site may also link to other websites. We do not control those sites and are not responsible for their content or how they handle your information.
9. Disclaimers
We provide this site "as is" and "as available." To the extent Texas law allows, we make no promises that the site will always be available, free of errors or free of viruses, or that its information is complete and current.
This section is about the website only. Any warranty on construction work we perform is set out in your written contract.
10. Limits on Liability
To the extent Texas law allows, Jimenes Construction is not liable for any indirect, incidental, special or consequential damages that come from using or not being able to use this site. This includes lost profits and lost data. For any claim about the site itself, our total liability is limited to one hundred dollars ($100).
These limits apply to the website only. They do not change anything in a written construction contract, and they do not limit any liability that Texas law does not allow us to limit.
If you misuse the site or break these terms, you agree to cover the reasonable costs, including attorney's fees, of any claim against us that results.
11. Texas Law & Harris County
Texas law governs these terms, without regard to its conflict-of-law rules. Any dispute about these terms or this site will be decided in the state courts in Harris County, Texas, or in the United States District Court for the Southern District of Texas, Houston Division. You and we both agree to those courts. Disputes about a construction project are handled the way your written contract says.
If a court finds any part of these terms unenforceable, the rest still applies.
12. Changes to These Terms
We may update these terms from time to time. When we do, we will change the effective date at the top of this page. If you keep using the site after an update, you accept the updated terms.
