Pearland is zoned, and that is the first thing that sets it apart from Houston. Every lot has to be zoned before it can be platted, developed, or permitted, and most work also needs a Site Preparation Permit, which the city also calls a Site Work Permit. That permit reaches past the city limits into the ETJ, so a build in the Pearland part of Silverlake still answers to Pearland's rules even though the structure permit comes from Brazoria County. Unincorporated ETJ lots, such as Silverlake, are permitted by Brazoria County, which requires a permit for structures over 200 square feet. Either way, the city's Site Preparation Permit still applies to most development in the ETJ, and we confirm the right office before we bid.
Usually yes. New commercial development has to hold its stormwater to city criteria and to Brazoria Drainage District No. 4 rules on the major channels. Small sites may be able to buy into regional detention where they qualify and capacity exists; otherwise it is sized on site. We work the detention out with your engineer before we price the earthwork.
Inside the city, the lowest floor has to be at least a foot above the base flood elevation and a foot above the top of the curb. On unincorporated Brazoria County lots in the flood zone, the rule is two feet above the FEMA elevation. Outside a flood hazard area, the county recommends about 24 inches above grade. The Brazoria County flood maps were last revised on December 30, 2020, so we check the current panel for your lot.
Lake Charles clay. It is 45 to 60 percent clay and opens cracks up to two inches wide in a dry spell, with the cracks staying open 60 to 90 days a year, then it swells shut when the rain returns. It depends on the lot. On undeveloped or commercial land, protected trees of 12 inches in diameter or more need a tree survey and an approved disposition plan before the city issues a development permit. All of Brazoria County sits in the Texas Windstorm Insurance Association designated area, so a metal building needs a WPI-8 windstorm certificate to be eligible for TWIA wind coverage.
